1) Any attendee assumes all risks and accepts sole responsibility for any injury (including, but not limited to, personal injury, assault, defamation, disability, and death), illness, damage, loss, claim, liability or expense, of any kind whatsoever, that attendee may feel, experience or incur in connection with attending the event. Any attendee of the Winter Night Club is attending a dinner at the Broadmoor Hotel or other venue under these Terms of Use.
2) Also, relating to global COVID-19 pandemic, attendee understands and acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk of exposure, health problems, or infection by attending any dinner and or event. The attendee agrees to comply with all Security Procedures or COVID-related procedures that may be implemented by the hotel or Winter Night Club.
3) Because the venue or Broadmoor Hotel is 100% in control of the Alcohol distribution and consumption on the premises during the dinner, the Hotel and its Subsidiaries and staffs are directly responsible for: “Dram Shop Liability,” or social host liability.
4) Because the venue or hotel or restaurant provides the food based on your purchase, the hotel or venue is responsible for any risks as per food, burns from food or drinks, uncooked food or tainted food or drinks, allergy problems, cross contamination problems, spoilage risks, and related risks.
5) The hotel provides parking and valet services. All attendees should be careful walking in and out of the dinner and use care with the facilities in the venue and hotel. Attendees who use valet parking should consider tipping for any services provided. Please read your valet ticket for any terms and conditions for your automobile or other vehicle.
6) The Winter Night Club is not responsible for any opinions or behavior of the speakers at the event. If you have a problem with the speaker or their opinions, please contact them directly.
7) Winter Night Club and WinterNightClub.com are a registered non-profit corporation #19871648210 in the State of Colorado USA and retains the right to legal action against anyone who violates any laws civil or criminal during or after the events. Winter Night Club reserves the rights to the venue and jurisdiction of El Paso County, Colorado USA courts or the federal Magistrate Judge of Colorado Springs.
